WAI 262 – Full report released

The Waitangi Tribunal’s Wai 262 report Ko Aotearoa Tenei, was publicly released at Roma Marae, on 2 July 2011.

The report is broken down into the following chapters:

  • Taonga works and Intellectual Property;
  • Generic and biological resources of taonga species;
  • Relationships with the environment;
  • Taonga and the Conservation Estate;
  • Te Reo Maori;
  • When the Crown controls matauranga Maori;
  • Rongoa Maori; and
  • The making of international instruments

 

While recording the evidence and submissions relating to relevant historical matters, the Tribunal has largely focussed this report on the requirements of contemporary law and policy development in a way that reflects the partnership relationship contemplated under the Treaty of Waitangi.

Accordingly, a consistent theme is the importance of the principle of partnership in relation to decision-making, policy development and appointments to management and decision-making bodies in relation to the topics covered in each chapter. Another prominent theme is the focus on the relationships and obligations of kaitiaki in relation to taonga and matauranga Maori, rather than their ownership. The Tribunal has recommended a range of changes across sectors of Government considered in the inquiry, and these proposals are summarised in the conclusion chapter (chapter 9). The report covers such a wide range of topics and in sufficient detail that even an initial Crown response is likely to be some time.
